English Success Hub – Terms & Conditions

1. Agreement

By booking, purchasing, or participating in any services provided by English Success Hub (the “Company”), you (the “Parent” or “Client”) agree to enter into a legally binding agreement on behalf of yourself and the student (the “Student”).

This Agreement applies to all tuition services, memberships, workshops, digital products, and any other services provided by the Company.


2. Fees Payable

All fees are payable in advance of services being delivered.

Bespoke or concierge-style services are subject to individually agreed fees.

Pricing may be adjusted to reflect the number of weeks remaining in the academic year or the duration of a course.

The Company reserves the right to review and amend fees at any time, with a minimum of 30 days’ written notice.


3. Payment & Commitment

All payments must be made in advance. Services will not be delivered without prior payment.

Payments are collected automatically:

  • On a recurring monthly basis for subscription services
  • At the point of booking for one-off services

No retrospective payments are accepted.

Payment records and receipts are accessible via the Kajabi platform.

Manual invoices will only be issued upon request.


4. Cancellation by the Student / Parent

1:1 Sessions

A minimum of 48 hours’ notice is required to reschedule a session.

Sessions cancelled with less than 48 hours’ notice will be treated as completed and are non-refundable and non-transferable.

Group Sessions / Memberships

Fees remain payable regardless of attendance.

Catch-up materials or recordings may be provided at the Company’s discretion.


5. Cancellation by the Company

1:1 Sessions

At least 24 hours’ notice will be given where reasonably possible.

Where sufficient notice has been given, the session will be rescheduled at a mutually agreed time, subject to the Tutor’s availability.

If the Student is unable to attend the rescheduled session offered, the session will be considered fulfilled and no refund or credit will be issued.

Group Services / Programmes

Fees cover the programme as a whole rather than individual sessions.

Where a session cannot be delivered, the Company may provide:

  • A rescheduled session
  • A recording
  • Alternative resources

This will be determined at the Company’s discretion.


6. Late Arrival

1:1 Sessions

The Tutor will wait a maximum of 10 minutes. After this time, the session may be treated as completed.

Group Sessions

Sessions begin promptly. Late arrival does not entitle the Student to additional time or a refund.


7. Warranties & Academic Outcomes

The Company provides high-quality tuition based on professional expertise and experience.

However, no guarantees are made regarding:

  • Specific grades
  • Exam outcomes
  • Academic performance

Results depend on factors outside the Company’s control, including student effort and external assessment conditions.


8. Limitation of Liability

The Company shall not be liable for any indirect or consequential loss, including but not limited to:

  • Loss of academic opportunity
  • Exam performance outcomes
  • Future educational results

The Company’s total liability shall not exceed the total fees paid for the relevant services.


9. Force Majeure

The Company shall not be liable for failure or delay in performing its obligations where such failure arises from events beyond reasonable control, including but not limited to:

  • Illness
  • Internet or technology failure
  • Power outages
  • Unforeseen circumstances

10. Safeguarding

English Success Hub is committed to safeguarding and promoting the welfare of all students.

Parents are responsible for ensuring appropriate supervision during online sessions where required.

All safeguarding concerns will be handled in accordance with UK safeguarding legislation and relevant professional guidelines.


11. Communication

Standard communication is via email.

For services that include ongoing support (such as concierge packages), additional communication channels (e.g. WhatsApp) may be used. A Parent/Guardian will always be included.

All communication must remain appropriate and related to academic support.


12. Intellectual Property

All materials provided by English Success Hub, including but not limited to:

  • Workbooks
  • Lesson materials
  • Recordings
  • Guides

remain the intellectual property of the Company.

Materials may not be copied, shared, distributed, or resold.

Breach of this clause may result in immediate termination and potential legal action.


13. Recording of Sessions

Some sessions may be recorded for quality assurance, training, or student access purposes.

By participating in services, you consent to such recordings.

All recordings remain the property of English Success Hub and must not be shared or distributed.


14. Obligations

Tutor Obligations

The Tutor will:

  • Prepare and deliver lessons to a high professional standard
  • Provide agreed resources and feedback
  • Maintain confidentiality
  • Uphold safeguarding standards

Student Obligations

The Student agrees to:

  • Attend sessions punctually
  • Engage respectfully and positively
  • Complete work where required
  • Maintain an appropriate learning environment

15. Personal Data (GDPR)

English Success Hub acts as the Data Controller.

We collect only necessary personal data, including:

  • Parent and Student names
  • Contact details
  • Date of birth (where relevant)
  • Payment information

Data may be stored via secure platforms including Kajabi and Stripe.

Data is retained for a minimum of 6 years.

Parents may opt in to receive updates and marketing communications.


16. Late Payment & Refunds

All fees are strictly non-refundable, unless the Company cancels services without providing a reasonable alternative.

Failure to make payment may result in:

  • Immediate suspension of services
  • Loss of booked sessions

The Company reserves the right to charge statutory interest on overdue payments at 8% above the Bank of England base rate.


17. Ongoing Services & Notice Period

For ongoing services (including 1:1 tuition, memberships, and concierge packages), a minimum of 28 days’ written notice is required to cancel.

During the notice period:

  • All scheduled sessions remain payable
  • Sessions will continue as normal

Failure to provide sufficient notice will result in fees remaining payable for the full notice period.

The Company does not guarantee the retention of specific time slots beyond the notice period.


18. Termination

The Parent may terminate services in accordance with the notice period outlined above.

The Company reserves the right to terminate this Agreement:

  • With 28 days’ notice, or
  • Immediately in cases of:
    • Non-payment
    • Serious breach of these Terms
    • Inappropriate or disruptive behaviour

19. Service-Specific Terms

Additional terms may apply depending on the service purchased.

1:1 Concierge Tuition

  • Includes scheduled sessions
  • Includes personalised resources and feedback
  • May include ongoing communication support

Group Memberships

  • Includes weekly live sessions
  • May include access to resources and recordings
  • Fees are ongoing and not dependent on attendance

Workshops / Masterclasses

  • One-off sessions
  • Non-transferable and non-refundable
  • Recordings may be provided at the Company’s discretion

20. Changes to Terms

The Company reserves the right to amend these Terms at any time.

Where significant changes are made, a minimum of 28 days’ notice will be provided.


21. Governing Law

These Terms shall be governed by and interpreted in accordance with the laws of England and Wales.
